South Jersey Employment Discrimination Lawyers Discuss Firing of Transgender Employee

A Deptford, New Jersey Wal-Mart employee has filed a lawsuit alleging that she was harassed and then fired from the company because of her gender identity. The employee began working at the store in September of 2012. In January of 2013, she informed a manager that she was transitioning, began to express her gender identity and changed her nametag later that year.

In early 2014, a new manager began to make derogatory references to the employee related to her transgender status. Despite no reported problems between the employee and the other employees or with her work performance, this same manager began criticizing her performance, and writing her up with negative reviews. The manager also raised her voice and yelled at the employee, yet not at any other employee who was not transgender. The manager eventually fired the employee in June 2014.

Although federal law does not offer specific protections for gender identity in the workplace, New Jersey is one of 19 states and Washington, D.C. whose laws specifically protect those who are transgender from workplace discrimination. The Civil Rights Act, Title VII, offers protection from sex-based discrimination. The Equality Act, introduced to Congress in the summer of 2015, would explicitly ban employment discrimination against all LGBT (Lesbian Gay Bisexual Transgender) individuals.

The employee wishes to achieve protection for any other transgendered employees from suffering discrimination at work. She also wants to get her job back with Wal-Mart, as well as back pay.
