Defending Against Race Discrimination
At Sidney L. Gold & Associates, P.C., our compassionate team of lawyers knows just how difficult it can be for individuals who face race discrimination in the workplace. Despite putting in just as much if not more effort than other coworkers, it is not uncommon for minority employees to be passed up for advancement in the workplace.
Sometimes racial discrimination is not so subtle; minority employees have suffered verbal abuse and physical abuse based solely on their race or ethnicity.
Our South Jersey employment lawyers note that employees who suffer from race discrimination may also be targeted for religious or sex and gender discrimination as well. Even with the fear of retaliation, workers who are victims of race discrimination in New Jersey should know that the power to end the cycle lies in their hands.
Race discrimination can take many forms. Some employees who may be accustomed to such behavior may not even realize that they are being victimized, as it can be subtle.
Harsh Treatment
Employees who constantly find themselves scolded for their work ethic or who receive austere performance reviews that may affect their job status could be victims of race discrimination. Such treatment is unbecoming in office settings and may be easier to pick out; however, harsh treatment due to race discrimination may be harder to pinpoint in high stress industries such as construction or factory jobs, but that does not mean it cannot occur.
Racial Epithets
Certain names, while not inherently pejorative in nature, could be used in a disparaging tone, making them discriminatory. Depending on the tone and context in which they are said, specific words can actually be used in a discriminatory manner.
Less subtle however are racial epithets. No matter what the context, whether it was overheard in a light-hearted anecdote or said angrily to a person, racial epithets are dehumanizing and degrading and have no place in the workplace. Oftentimes, coworkers or supervisors, claiming to have a good rapport with an individual, will defend their use of a racial slur as only being a joke. However, defense of such behavior often precedes harsher, more discriminatory behavior.
Denial of Promotion and Retaliation Based on Race
Sadly, some employers give out promotions or hire based solely on someone’s race, oftentimes operating under the influence of prejudice and preconceived notions regarding a race. Employees who call out such discriminatory hiring and promoting practices by seeking the aid of a skilled employment lawyer will often find themselves subject to retaliation in the form of demotions, loss of pay, or even wrongful termination.
