New Jersey Law Against Discrimination (NJLAD)

The protections involved in NJLAD include protection for employees in the workplace and for public accommodations. This means that an owner, manager or employee of a place that offers goods or services to the public – like a restaurant, hotel, doctor’s office, theater, or camp – is prohibited from directly or indirectly withholding accommodations or services from an individual because of his or her race, sex, creed, color, marital status, sexual orientation, gender identity, or disability.

Exceptions to this aspect of the law include dressing rooms or gymnasiums, which are restricted to a specific gender. Also, schools that are religious institutions may not fall under the provisions of the LAD due to the distinctly private nature of the institution. Conversely, it is against the law for a private club to deny membership for an individual on the basis of their race, creed, color, nationality, marital status, sex, or sexual orientation.

Filing a Discrimination Complaint

If an individual feels that they have been discriminated against, he or she may file a complaint with the Division of Civil Rights at New Jersey Attorney General’s office.
